ActivityTimer Terms of Use
These terms cover your use of the ActivityTimer app. By downloading or using the app, you agree to them. If you don't agree, please don't use the app.
1. About these terms
These Terms of Use apply to ActivityTimer on all platforms, published by 2A Software Developers ("we", "us", or "our"). They add to our general Terms of Service. If the two conflict, these terms apply to ActivityTimer. How the app handles your data is described in the ActivityTimer Privacy Policy.
2. Your license to use the app
We give you a personal, non-exclusive, non-transferable, revocable license to use ActivityTimer on devices you own or control, in line with these terms and the rules of the store you got it from. All rights not expressly granted to you remain with us.
3. Price
ActivityTimer is currently free to download and use. It has no ads and no in-app purchases. If we add paid features in the future, their price will be shown before you are asked to pay, and our general Terms of Service and Refund Policy will apply to those purchases.
4. Your data and backups
Everything you record is stored only on your device. We don't keep a copy, so we can't recover it for you. You are responsible for your data, including making backups if you want them. You can make one at any time with Export as CSV in the app's Settings. Your data can be lost permanently if you:
- choose Erase all data in the app's Settings;
- choose Restore from CSV, which replaces all your activities and history with the ones in the file;
- delete the app; or
- lose, reset, or replace your device without a backup.
Exported CSV files aren't encrypted, and anyone who has one can read it. Keep them somewhere safe.
5. Accuracy of recorded times
The app records times using your device's clock. If the clock is wrong, or is changed while a timer is running, recorded times may be wrong too. You can correct sessions in History. ActivityTimer is a personal tool: if you use it for billing, payroll, timesheets, or other records where accuracy matters, check the times yourself before relying on them.
6. Targets and stats
Targets, totals, and stats are there to help you see how you spend your time. They are not professional, medical, health, or fitness advice.
7. The timer outside the app
While a timer runs or is paused, its activity name and time can appear on your Lock Screen, in the Dynamic Island, on a paired Apple Watch, in your notifications and status bar, in home screen widgets, and in the Mac menu bar, where other people may see them. Depending on where it appears and on your settings, the timer can also be paused, resumed, or stopped from there, and on a Mac, a timer can be started from the menu bar. You can control this in the app's Settings and in your device's notification and widget settings.
8. Acceptable use
You must not:
- copy, modify, distribute, sell, rent, or sublicense the app;
- reverse engineer, decompile, or disassemble the app, except where the law allows this despite this restriction; or
- use the app in a way that breaks any law that applies to you.
9. Ownership
The app, including its software, design, name, and icon, belongs to 2A Software Developers or our licensors. The activities and sessions you record are yours.
10. Updates and availability
We may update, change, or stop offering the app or any of its features at any time. Some updates may be needed to keep using the app, and some may need a newer version of your device's operating system. We don't promise that the app will always be available, work on every device, or be free of errors.
11. Disclaimer of warranties
To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or revenue, arising from your use of, or inability to use, the app. Our total liability for any claim relating to the app is limited to the amount you paid for it, if any.
Nothing in these terms limits any liability that cannot be limited by law, or your rights as a consumer under the laws of the place where you live.
13. Ending these terms
You can stop using the app at any time by deleting it. If you break these terms, your license to use the app ends automatically, and you must stop using the app and delete it. Sections 9, 11, and 12 continue to apply after these terms end.
14. App store terms
You may have downloaded the app from the Apple App Store, Google Play, or the Microsoft Store. That store's own terms also apply to your download and use of the app.
If you downloaded the app from the Apple App Store, you and we also agree that:
- these terms are between you and us only, not Apple, and we, not Apple, are solely responsible for the app and its content;
- your use of the app must also follow the Usage Rules in Apple's Media Services Terms and Conditions;
- Apple has no obligation to provide any maintenance or support for the app;
- if the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app;
- we, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws;
- if a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling, and discharging that claim;
- you confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties; and
- Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
15. Changes to these terms
We may update these terms from time to time. The updated version will be posted on this page with a new effective date. If you keep using the app after a change takes effect, you accept the updated terms.
16. Governing law
These terms are governed by the laws of the Republic of Uganda, without prejudice to any mandatory consumer protection rights that apply to you in your place of residence.
